Soffun – Terms of Use

Welcome to Soffun. These Terms of Use (“Terms”) govern your access to and use of our website, application, features, products, and services (collectively, the “Service”). By accessing or using Soffun, you agree to comply with and be bound by these Terms.

If you do not agree to these Terms, please do not access or use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using the Service, you confirm that:

  • You are at least 18 years old or the legal age of majority in your jurisdiction.
  • You have read, understood, and agreed to these Terms.
  • You are legally capable of entering into a binding agreement.

2. Use of the Service

  • Attempt to gain unauthorized access to the Service, servers, or user accounts.
  • Upload content that is illegal, abusive, harmful, or violates intellectual property rights.

4. Purchases, Tips & Events

Certain features on Soffun allow users to purchase Denard tokens, pay for events, or tip creators.

  • Tips: All tips are non-refundable.
  • Denard Tokens & Event Exchanges: Covered under our Refund Policy, which explains refund timelines, conditions, and procedures. By making a purchase, you agree to the Refund Policy.

5. User Content

Users may upload content, participate in events, and interact with creators.

You agree that:

  • You own or have permission to use the content you upload.
  • You grant Soffun a non-exclusive, royalty-free license to store, display, and use your content for service functionality.
  • You will not upload unlawful, harmful, or copyrighted material without permission.

We may remove any content that violates our policies.

6. Intellectual Property

All content, branding, features, code, graphics, and materials available on Soffun are the property of Soffun, LLC.

You may not copy, modify, distribute, or create derivative works without our written permission.

7. Privacy

Your use of the Service is governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

By using the Service, you consent to the processing of your information as described in the Privacy Policy.

8. Payments

Payments made on Soffun are processed by trusted third-party providers such as Apple, Google, or Stripe, depending on your device or payment method.

Soffun does not store your payment card details.

Your use of paid services indicates acceptance of the third-party processor’s terms and policies.

9. Prohibited Activities

You agree NOT to:

  • Use the Service for illegal or harmful activities.
  • Impersonate another person or provide misleading information.
  • Attempt to disrupt the platform functionality.
  • Share or sell access to your account.
  • Upload viruses, malicious code, or attempt hacking activities.

Violations may lead to account suspension or legal action.

10. Termination

We may suspend or terminate your account immediately, without notice, if:

  • You violate these Terms.
  • Your actions harm the platform or other users.
  • Required by law enforcement or legal obligation.

You may also delete your account at any time.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available” without any warranties, expressed or implied.

We do not guarantee:

  • Continuous or error-free service.
  • That content will always be available.
  • That the Service is free of viruses or harmful components.

You use the Service at your own risk.

12. Limitation of Liability

To the maximum extent permitted by law, Soffun is not liable for:

  • Any indirect, incidental, or consequential damages
  • Loss of data, revenue, or profits
  • Issues caused by third-party service providers
  • User-generated content or interactions

Our total liability shall not exceed the amount you paid to use the Service in the last 12 months.

13. Changes to the Terms

We may update these Terms from time to time. Any changes will take effect immediately upon being posted.

Continued use of the Service after updates means you accept the revised Terms.

14. Governing Law

These Terms are governed by the laws of Georgia, United States, without regard to conflict-of-law principles.
