Monetization Terms and Agreement

Soffun Terms of Service for Creators

1. Overview

Welcome to Soffun. These Terms of Service (“Terms”) govern your access to and use of the Soffun platform as a Creator. By signing up and using Soffun, you agree to the following terms and conditions, which form a legally binding agreement between you and Soffun.

2. Monetization & Earnings

  • Pay-Per-View Model: Soffun allows Creators to host livestreams and receive revenue from ticket sales and tips.
  • Revenue Share: Creators keep 85% of ticket revenue. Soffun retains a 15% platform fee.
  • First Event Promo: Creators may receive 100% of revenue from their first livestream hosted within the first month of approval. This promotion is subject to change at Soffun’s discretion and does not guarantee future eligibility.

3. Event Hosting & Content

  • Livestream Ephemerality: Soffun does not store or archive livestreams. Creators may independently record and repurpose content.
  • Prohibited Uses: Creators may not livestream or promote illegal content, hate speech, harassment, or fraudulent activity.
  • Tipping & Engagement: All user tips are subject to the same revenue share terms as ticket sales.

4. Independent Contractor Relationship

You acknowledge that you are an independent contractor, not an employee or agent of Soffun. You are solely responsible for:

  • Managing your livestream content and schedule
  • Paying any applicable taxes on your earnings
  • Complying with all relevant laws and regulations

Nothing in this agreement creates an employment, joint venture, or partnership relationship between you and Soffun.

5. Taxes

You are responsible for reporting and paying all taxes associated with your revenue from Soffun, including income tax, self-employment tax, and any required business licenses or permits.

6. Account Termination

Soffun reserves the right to suspend or terminate your account at any time if you violate these Terms, abuse the platform, or otherwise act in bad faith. Any outstanding earnings prior to termination will be processed in accordance with our payout schedule.

7. Intellectual Property

  • Ownership: You retain all rights to your independently recorded content.
  • Platform Data: Soffun may use non-audio/visual data (e.g., ticket sales, chat logs, tips, reviews) for internal analytics and non-commercial marketing.
  • Use of Likeness: You grant Soffun a limited license to use your name, image, and likeness for promoting your Soffun content. Commercial use (e.g., paid ads) requires your separate written consent.

8. Community Standards

Creators must adhere to Soffun’s Community Guidelines. Violations may result in account suspension, termination, or legal action.

9. Platform Changes

Soffun may update, modify, or discontinue features of the platform at any time. We’ll make reasonable efforts to notify you of major changes, but it is your responsibility to review these Terms periodically.

10. Limitation of Liability

Soffun is not liable for any damages arising out of your use of the platform, including but not limited to lost profits, data loss, or platform downtime.

11. Dispute Resolution & Governing Law

If a dispute arises, you agree to resolve it through good faith mediation in Atlanta, Georgia. If unresolved, legal action must be brought exclusively in the courts of Atlanta, GA.
